What is an ICP licence and why is it mandatory?
An ICP (Internet Content Provider) licence is issued by China's MIIT and is legally required for any website with a .cn domain or hosted in mainland China. Commercial ICP licences (ICP 经营性) are required for e-commerce and paid services; non-commercial (ICP 备案) for informational sites. Without an ICP licence, hosting providers in China will not serve your website. Foreign companies need a mainland China-registered entity to apply.
How does PIPL differ from GDPR for website compliance?
PIPL requires: explicit consent for all personal data processing (broader than GDPR's legitimate interest basis); mandatory data localisation for critical information infrastructure operators; security assessments by CAC (Cyberspace Administration of China) before transferring personal data overseas; DPO designation for large processors; breach notification within 72 hours. Unlike GDPR, PIPL has no 'legitimate interest' basis — consent or explicit legal provision is required for all processing.
