Decree 13/2023/ND-CP (Personal Data Protection Decree), effective July 2023, is Vietnam's data privacy regulation. It requires: consent before collecting and processing personal data; purpose limitation; breach notification to MPS (Ministry of Public Security) within 72 hours; cross-border data transfer only to countries approved by MPS; and data retention limited to stated purposes. Vietnamese websites must implement consent mechanisms, publish Vietnamese-language privacy policies, and establish a process for handling data subject requests.
What is MoIT e-commerce registration and who needs it?
Vietnam's Decree 52/2013 (amended by Decree 85/2021) requires all e-commerce websites operating in Vietnam to register at online.gov.vn (Ministry of Industry and Trade portal). This applies to: websites selling goods or services to Vietnamese consumers with a Vietnamese domain (.vn) OR foreign-domain sites with Vietnamese as a primary interface language. Registration requires: business registration, website owner ID, and functional Vietnamese-language terms of service and return policy.
